Public Offer Agreement

1. Parties

Provider — RID Analytics LLC, director D. Ermolaev, KZ IIN БИН 231140025216 (ТОО RID Analytics), Republic of Kazakhstan, contact: hi@toxicbwi.site.

Customer — the user who accepted the offer.

2. Subject

The Provider grants the Customer access to the toxicbwi service (software development and automation services) on a subscription basis. The Service comprises the web cabinet https://dev.toxicbwi.site.

3. Acceptance

Payment of the subscription or clicking the “I Accept” button on the site constitutes acceptance under Art. 396 of the RK Civil Code.

4. Price and payment

Tariffs at https://dev.toxicbwi.site/#pricing. Subscription auto-renews unless cancelled before the period end.

5. Refunds

The Service is digital and delivered instantly. A refund for the unused portion of a period is available within 14 days of payment provided the Customer has not used the paid functionality. After use no refund is given. Art. 14 of the RK Consumer Protection Act (goods-return right) does not apply to digital services.

6. Age

The Service is available to persons aged 18+ or with legal-representative consent.

7. Prohibited use

Spam, infringement of third-party rights, circumvention of Telegram limits, reverse engineering, resale of access.

8. Liability

The Service is provided “as is”. The Provider’s liability is capped at the last paid month’s subscription. The Provider is not liable for decisions the Customer makes based on Service output.

9. Force majeure

Including Telegram blocking, third-party API withdrawal, state communication restrictions.

10. Governing law and disputes

Law of the Republic of Kazakhstan. Disputes — RK courts at the Provider’s seat. Mandatory pre-trial claim, 30-day response period.
